Terms of Service
1. Acceptance of Terms
By accessing or using KalTalk ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are entering into these Terms on behalf of an organization, you represent that you have authority to bind that organization. If you do not agree, do not use the Service.
2. Service Description
KalTalk is an AI customer communication platform that lets human operators and AI agents share one inbox across support, sales, and other customer-facing channels. The Service includes a chat widget, knowledge base, agent dashboard, and developer API.
3. Account Registration
You must be at least 18 years old to create an account. You agree to provide accurate information and to keep it current. You are responsible for safeguarding your credentials and for all activity under your account. Notify us immediately of any unauthorized use.
4. Subscriptions, Billing, and Refunds
KalTalk offers tiered plans (Starter, Pro, Team, Growth, Enterprise). Paid plans are billed in advance on a recurring basis (monthly or annually). Usage that exceeds plan limits is billed as overage at the rates published on the pricing page.
You may cancel at any time. Cancellation stops future renewals; we do not provide refunds for partial billing periods or unused capacity, except where required by law. We may change pricing with at least 30 days' notice; changes apply at the start of the next billing cycle.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful, harmful, or fraudulent purpose
- Send spam, phishing, malware, or unsolicited bulk messages
- Harass, threaten, or abuse end users or KalTalk staff
- Attempt to reverse-engineer, decompile, or extract source code from the widget or platform
- Scrape, crawl, or otherwise harvest data from the Service in ways that exceed normal API use
- Circumvent rate limits, plan caps, or access controls
- Upload content that infringes intellectual property or violates third-party rights
- Resell or sublicense the Service without our written consent
We may suspend or terminate accounts that violate these rules.
6. Customer Data
You retain ownership of all data you submit to the Service, including conversation history, knowledge base content, and customer information ("Customer Data"). You grant KalTalk a worldwide, non-exclusive license to host, process, and transmit Customer Data solely to provide and improve the Service.

7. AI-Generated Output
Responses generated by AI agents are produced by machine learning models and may be inaccurate, incomplete, or inappropriate for a given context. AI output is not legal, medical, financial, or professional advice. You are responsible for reviewing AI output before relying on it and for any actions taken based on it. KalTalk does not warrant the accuracy of AI-generated responses.
8. Intellectual Property
KalTalk and its licensors own all rights, title, and interest in the Service, including software, design, trademarks, and documentation. These Terms grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with your plan. No other rights are granted by implication.
9. Service Availability
We work to keep the Service available but do not guarantee uninterrupted operation. The Service is provided on a best-effort basis except where a written SLA is included with your plan. We may perform scheduled maintenance and will give reasonable notice for downtime that affects core functionality.
10. Termination
You may close your account at any time from the dashboard. We may suspend or terminate your access if you breach these Terms, fail to pay, or use the Service in a way that poses a risk to KalTalk or other users. On termination, your right to use the Service ends immediately. We will retain or delete Customer Data in line with the retention terms in our Privacy Policy.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement. KalTalk does not warrant that the Service will be error-free, secure, or meet your specific requirements.
12. Limitation of Liability
To the fullest extent permitted by law, KalTalk's total liability arising out of or relating to these Terms or the Service is limited to the amount you paid to KalTalk in the 12 months preceding the claim. KalTalk is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, even if advised of the possibility of such damages.
13. Indemnification
You agree to indemnify and hold KalTalk harmless from any claims, damages, or expenses arising from your use of the Service, your Customer Data, or your breach of these Terms.
14. Governing Law
These Terms are governed by the laws of the State of Israel, without regard to its conflict-of-law principles. Any dispute arising from these Terms or the Service will be resolved exclusively in the competent courts of Tel Aviv-Jaffa, Israel.
15. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated by email or in-app notice at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
